Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and Pin Traveler, LLC ("Pin Traveler", "we", "us", or "our") governing your use of the Photo Optimizer iOS application (the "App") and the Photo Optimizer website (together, the "Service"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Service Owner

The Service is owned and operated by Pin Traveler, LLC, 1401 Pennsylvania Ave STE 105 Box 1748, Wilmington, DE 19806, USA. You can reach us at hello@pintraveler.net.

We may change, suspend, or discontinue any part of the Service at any time, without notice and without liability to you.

2. International Use and Export Controls

If you use the Service from outside the United States, you are responsible for complying with your local laws. The App is subject to United States export control laws, and you may not download, export, or re-export it in violation of those laws.

3. Eligibility

The Service is intended for users who are at least 18 years old. By using the Service, you confirm that you are at least 18, that you are not located in a country subject to a U.S. government embargo, and that you are not listed on any U.S. government list of prohibited or restricted parties.

4. Privacy

Photo Optimizer processes your photos entirely on your device; your photos are never uploaded to our servers. Our Privacy Policy explains what limited data we collect, such as device identifiers, usage analytics, and crash reports, and how we share it. The Privacy Policy is part of these Terms.

5. Your Photos and Your Responsibility

Photo compression reduces file size by permanently discarding image data. Results may differ from the original in quality, color, or detail, and the App's previews and size estimates may not exactly match the final output.

  • Overwriting is permanent. If you choose to overwrite an original photo with a compressed version, the original cannot be recovered through the App. Review each preview carefully before confirming.
  • Keep backups. You are solely responsible for backing up your photos before using the App, for example with iCloud Photos or another backup service.
  • Your content. You are responsible for making sure you have the right to modify and share the photos you process with the App.

To the fullest extent permitted by law, we are not responsible for any loss of, damage to, or reduction in quality of your photos or other data, and you waive any claims against us for such loss.

6. Intellectual Property

The Service, including its software, design, text, graphics, logos, and trademarks, is owned by or licensed to Pin Traveler and is protected by copyright, trademark, and other laws. Except for the limited license below, nothing in these Terms gives you any right, title, or interest in the Service. You keep all rights to your own photos.

7. License to Use the App

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, as permitted by the App Store's Usage Rules. You may not:

  • Copy, modify, or create derivative works of the App;
  • Use the App for any commercial purpose other than processing your own photos;
  • Decompile, reverse engineer, or disassemble the App, except where the law expressly allows it;
  • Remove any copyright or other proprietary notices;
  • Rent, lease, sell, sublicense, or otherwise transfer the App to anyone else.

This license ends automatically if you violate these Terms.

8. Apple App Store

These Terms are between you and Pin Traveler only, not Apple Inc. ("Apple"). Pin Traveler, not Apple, is solely responsible for the App and its content. Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the App, if any; to the maximum extent permitted by law, Apple has no other warranty obligation for the App. Apple is not responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to meet any legal or regulatory requirement, consumer protection claims, or claims that the App infringes a third party's intellectual property rights. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

9. Feedback

If you send us suggestions, ideas, or other feedback about the Service, we may use them for any purpose without any obligation to you.

10. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any law;
  • Bypass, disable, or interfere with any security features, purchase verification, or access restrictions of the Service;
  • Use bots, scrapers, or other automated means to access the website;
  • Upload or transmit viruses or other malicious code;
  • Impersonate Pin Traveler or misrepresent your affiliation with us;
  • Interfere with or disrupt the Service or the networks connected to it.

11. Fees and Payment

  • Some features of the App require a paid subscription or purchase. All purchases are processed by Apple through the App Store and are subject to Apple's terms and policies.
  • Auto-renewal. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours before the current period ends.
  • Cancellation. You can manage or cancel your subscription in your Apple ID account settings. Cancelling stops future renewals; you keep access until the end of the current paid period.
  • Free trials. If we offer a free trial, you will be charged when the trial ends unless you cancel before then. Any unused portion of a free trial is forfeited when you purchase a subscription.
  • Refunds. Refunds are handled by Apple under its refund policies. We cannot issue refunds for App Store purchases directly.
  • Price changes. We may change prices at any time. Price changes for existing subscriptions take effect at the next renewal, with notice as required by Apple and applicable law.
  • Lifetime access. Any "Lifetime" subscription, purchase, or promotional unlock, including lifetime access granted to early downloaders at launch, is limited to the lifetime of the App. It is not refundable if we permanently discontinue the App or cease operations.

12. Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT COMPRESSION RESULTS, PREVIEWS, OR STORAGE SAVINGS ESTIMATES WILL BE ACCURATE OR MEET YOUR EXPECTATIONS.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PIN TRAVELER AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PHOTOS, PROFITS, OR REVENUE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT, IF ANY, THAT YOU PAID FOR THE APP DURING THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

14. Changes to These Terms

We may revise these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Continuing to use the Service after changes are posted means you accept the revised Terms, so please check this page periodically.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law rules. The state and federal courts located in Dallas, Texas, USA have exclusive jurisdiction over any dispute arising from these Terms or the Service, except that if you are a consumer, you may also bring claims in the courts where you live, as permitted by local law.

16. Termination

We may suspend or end your access to the Service at any time, without notice or liability, including if you violate these Terms. You can stop using the Service at any time by deleting the App. Sections that by their nature should survive termination, including sections 5, 6, 9, and 12 through 17, will survive.

17. General Provisions

  • If these Terms are translated, the English version controls.
  • If any provision is found unenforceable, the remaining provisions stay in effect.
  • Our failure to enforce any right is not a waiver of that right.
  • These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service.
  • We may assign our rights under these Terms; you may not assign yours without our written consent.
  • Except as stated in section 8, there are no third-party beneficiaries of these Terms.
  • You consent to receive communications from us electronically.
